Terms of Service

These Terms of Service ("Terms") govern your use of the Divisi app, the website at divisi.africa, and our email and WhatsApp services (together, the "Service"), operated by Codefarm Technologies (Pty) Ltd ("we", "us", "our"), 26 Derrick Drive, Heritage Park, Somerset West, Western Cape 7130, South Africa.

By creating an account or using the Service you agree to these Terms, our Privacy Policy and our Community Guidelines. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By registering you confirm that you are 18 or older and able to enter into a binding agreement. We may close accounts we reasonably believe belong to minors.

2. Your Account

You register with a mobile phone number and sign in with a one-time code sent to your WhatsApp — there are no passwords. Once signed in, a device stays signed in until you sign out or remove it from another device. You are responsible for:

Keeping your phone secure and never sharing a sign-in code
Removing a lost or sold phone from your account in the app
All activity under your account
Keeping your details accurate

One person, one account. Accounts may not be sold or transferred.

3. The Service

Divisi helps farmers across Africa run their farms and learn from each other. It includes:

Farm records — fields, crops, plans, tasks, a diary and a farm ledger, which work offline and sync when you are back in signal
Advice for your own field — crop suitability, planting windows, tasks, weather and alerts, based on your farm's location
Farm teams — add people to help run your farm
The Hive — a public community for posts, questions and answers, plus the Weekday Quiz
Private messages — one-to-one conversations with other farmers
Partner programmes — programmes run by organisations that you may choose to join
The marketplace — for buying and selling farm produce and inputs, when it launches

The app is free for farmers. Every feature a farmer uses is free, with no paid tier and no card on file. Partner organisations pay for their dashboards under separate agreements. If we ever introduce a charge for farmers, including a marketplace fee, we will tell you before it applies and you will not be charged for anything you have not agreed to.

4. Your Farm Data

You own your farm data: your records, fields, crop plans, diary, photos and ledger. We process it only to provide the Service to you, as described in our Privacy Policy. We will not:

Sell your farm data to anyone
Show your name or fields to any organisation unless you agree to it
Show your ledger to any partner, ever

You give us a non-exclusive licence to store and process your farm data to provide the Service and to produce statistics that identify nobody. The licence to your identifiable data ends when your account is erased.

Farm teams

A farm's owner can add managers. Managers can see and change the farm's records, including its ledger. Only the owner can delete the farm or remove the owner. Add only people you trust, and remove anyone who no longer works with you. The owner is responsible for what their team does on the farm.

5. Advice Is Guidance, Not a Guarantee

Crop suitability, planting dates, weather, pest and disease information, market prices and other advice in the Service are estimates built from published data and models. They can be wrong for your field, and conditions change. Advice from other users on the Hive, in messages or in the marketplace is their own opinion, not ours, and they may not be qualified to give it.

Use your own judgement and check with a local extension officer or agronomist before a decision that could cost you money. Always follow the label and local law when using any chemical, seed or veterinary product.

6. The Hive and Your Content

The Hive is public. Posts, answers, comments and records you share can be seen by anyone, including on divisi.africa and in search engines. Nothing from your farm records reaches the Hive unless you choose to share it.

When you post content, send a message or create a listing, you:

Confirm it is yours, or that you have the right to share it
Keep ownership of it
Give us a non-exclusive, royalty-free, worldwide licence to host, display and distribute it within the Service, and to show public Hive content on our website and in share cards. This licence ends when you delete the content or your account, except for copies other people have already shared
Agree to follow our Community Guidelines

You can set your profile to Public or Private, and control what it shows, in the app's privacy settings.

7. Private Messages

You can message people you are connected with. Anyone else receives a message request, which they may accept or decline. Do not keep sending requests to someone who has declined or not replied.
Messages are private between the people in the conversation, but they are not end-to-end encrypted. Our staff do not read them, except when someone in the conversation reports it, to investigate abuse, fraud or a safety threat, or where the law requires it.
When you share a field or crop into a conversation, the other person can see it until you stop sharing it. Only share with people you trust.
The other person can keep what you send, for example by taking a screenshot. Unsend removes a message from Divisi, not from someone's memory or another device.
Our Community Guidelines apply in private messages exactly as they do on the Hive. Unwanted sexual content, threats, harassment and scams in messages are grounds for immediate termination.

8. The Marketplace

This section applies once the marketplace is available in your country.

Divisi is the meeting place, not the seller. Sales are agreed directly between buyer and seller. We are not a party to that agreement, do not own or inspect the goods, and do not guarantee their quality, safety, legality, delivery or payment — unless we clearly say otherwise for a particular feature.
Sellers must describe goods honestly (including quantity, grade, condition and any treatment), have the right to sell them, hold any licence or registration the law requires, and deliver what they agreed.
Buyers must pay as agreed and check goods on collection or delivery.
Prohibited items: anything illegal to sell where you or the buyer are, including banned or unregistered pesticides, counterfeit or uncertified seed where certification is required, stolen goods or livestock, animals without the movement permits the law requires, and anything our Community Guidelines forbid.
Stay safe. Keep the conversation on Divisi until you are ready to meet, meet in a public place, and never pay for goods you have not seen from someone you do not know. Nobody from Divisi will ever ask you for a sign-in code or for money.
Disputes are between the buyer and the seller. We may help where we can, and we will act against users who cheat, but we are not responsible for resolving them or for any loss.
We may remove any listing, limit selling, or close an account that breaks these rules, without notice.

If we add payments, delivery or other services to the marketplace, we will publish the terms for them before they launch.

9. Partner Programmes

Organisations such as NGOs, government extension services and contract-farming companies may invite you to join a programme on Divisi, usually through a code or a message on WhatsApp.

Joining is always your choice. Before you join we show you what the organisation will see; you decide.
Any agreement about inputs, prices, training or buying your crop is between you and that organisation. We are not a party to it and are not responsible for either side keeping it.
You can leave at any time by sending STOP to Divisi on WhatsApp, which ends every partner's access to your fields.

10. Safety: Zero Tolerance for Objectionable Content and Abusive Users

There is no tolerance on Divisi for objectionable content or for abusive behaviour towards other users, anywhere in the Service — the Hive, private messages or the marketplace. Objectionable content includes anything that is illegal, hateful, harassing, threatening, sexually explicit, violent, discriminatory, defamatory, fraudulent, deliberately misleading about farming practice in a way that could cause harm, or that targets a person for abuse.

Every Divisi user has these tools, in the app:

Report — flag any post or comment for review, from the button on the content itself
Block — block any user from one of their posts or from their profile, and report the post at the same time if you want to. They disappear from your feed and your messages immediately, and neither of you can see, follow or message the other again
Decline — turn down a message request; the sender cannot message you in that conversation again

Content that enough people report is hidden from the Hive automatically, before anyone on our side has looked at it. Every report reaches our moderators, and we aim to act on reports of objectionable content within one business day. To report a private message, block the sender and email us at developers@codefarm.africa with a screenshot. Where content breaches these Terms we remove it and suspend or terminate the account responsible. We may remove content or terminate an account without prior notice, and a terminated account may not re-register.

11. Prohibited Activities

You must not use the Service to:

Register with false information or impersonate anyone, including Divisi staff
Harass, threaten, bully, scam or harm other users
Send spam, bulk or unsolicited messages or requests, or advertise without being clear that you are
Ask anyone for their sign-in code, or for money under false pretences
Collect other users' personal information, or use it outside the Service without their permission
Scrape, copy or systematically extract data from the Service
Reverse-engineer or decompile the app, or get around any of its limits or security
Upload malware or harmful code
Access another user's account without permission
Use bots or scripts to interact with the Service without our written permission
Do anything unlawful

12. Intellectual Property

The software, design, name, logos and content we create are owned by or licensed to Codefarm Technologies (Pty) Ltd and protected by law. We give you a personal, non-transferable, revocable licence to use the Service for your own farming. You may not copy, redistribute or commercially exploit any part of the Service without our written permission — selling your own goods in the marketplace is, of course, allowed.

13. Notifications, WhatsApp and Email

We send sign-in codes and important account messages to your WhatsApp. With your permission we also send push notifications (farm tasks, weather alerts, messages, Hive activity) and, if you subscribe, emails. You can choose which notifications you receive and set quiet hours in the app, turn push notifications off in your phone's settings, and unsubscribe from any email with the link it contains.

14. Third-Party Services

The Service relies on third-party services, including WhatsApp, your phone's app store and notification service, and the providers described in our Privacy Policy. Your use of them is also governed by their own terms. We are not responsible for their availability or practices, or for external websites the Service links to.

15. Availability and Changes

We aim for high availability but cannot guarantee uninterrupted access. The app keeps working offline and syncs when you reconnect. We may change, suspend or retire features, and will give reasonable notice of changes that matter to you.

We may update these Terms. We will tell you about material changes in the app or by email before they take effect. If you keep using the Service after that, the new Terms apply; if you do not agree, you can delete your account.

16. Disclaimer of Warranties

The Service is provided "as is" and "as available". To the fullest extent the law allows, we give no warranties, express or implied, including of merchantability, fitness for a particular purpose and non-infringement. We do not warrant the accuracy of any forecast, recommendation or price, the conduct of any user or partner, or the goods sold in the marketplace.

17. Limitation of Liability

To the fullest extent the law allows, Codefarm Technologies (Pty) Ltd, its directors, employees and agents are not liable for any indirect, incidental, special or consequential loss arising from the Service, including crop loss, lost income or lost data, or from dealings between users, including marketplace sales and partner programme agreements.

Our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim (for a free service, zero).

Nothing in these Terms limits liability that the law does not allow to be limited, including for fraud, gross negligence, or death or injury caused by our negligence, or your rights under the Consumer Protection Act or similar laws where they apply.

18. Indemnification

You agree to indemnify Codefarm Technologies (Pty) Ltd and its officers, agents and employees against claims, losses and reasonable legal costs arising from (a) your content, messages or listings, (b) goods you sell or buy through the Service, (c) your breach of these Terms, or (d) your violation of anyone else's rights.

19. Termination

You may delete your account at any time from the Profile tab of the app — open Profile and choose Delete account. This ends these Terms.

Your account, your posts and your profile disappear from Divisi the moment you ask. For 30 days after that you can undo the request by signing in again and choosing to restore your account; once those 30 days pass, your account and the data it owns are erased for good and cannot be recovered. You do not need to contact us to delete your account.

We may suspend or terminate your access immediately and without notice if you breach these Terms, if the law requires it, or if continued access poses a security or legal risk. Your licence to use the Service then ends, and we handle your data as our Privacy Policy describes.

20. Governing Law and Disputes

These Terms are governed by the laws of the Republic of South Africa, and the courts of South Africa have jurisdiction, without taking away any protection the law of the country you live in gives you.

Please contact us at developers@codefarm.africa first so we can try to resolve any dispute informally. We will respond within 14 days.

21. General

Entire agreement. These Terms, our Privacy Policy and our Community Guidelines are the whole agreement between you and us about the Service. A partner organisation's own agreement with us does not change your rights under them.
Severability. If a provision is unenforceable, the rest continue in force.
No waiver. Not enforcing a right is not giving it up.
Assignment. We may transfer these Terms to a successor that takes over Divisi. You may not transfer your account or rights without our consent.
